ASF Liability Waiver and Rental Agreement

RENTAL RULES

Austin School of Furniture will be renting out its space qualified individuals on a month to month basis. Membership is month to month with a 15 days notice of cancellation required. A monthly recurring invoice will be sent to you. All membership fees must be paid within 5 of receiving the invoice or your membership will be canceled. ASF reserves the right to end anyones membership for any reason at any time.

Shop Rental Membership

$500 per month
Full usage of shop outside classroom hours
Dedicated personal bench storage space is included
Lockable cabinet included
Use of storage rack included
Hand tools are not included
Common areas and restrooms are included

I hereby agree to the following Austin School of Furniture Rental Rules:

I agree to clean up after myself each and every-time I come to the shop
I will treat all tools with respect and care
I will treat all other ASF members and staff with respect and care
I will not exceed my agreed upon membership hours if applicable
I will pay my Membership fee on time
I will let staff know immediately if a blade is dull or a tool is broken
I will empty trash when it is full or empty the dust bin when it is full
I will respect others' personal projects, tools and belongings

We will send you a liability waiver and month to month lease agreement that must be signed before your first day in the shop. Each renter must complete an hour long orientation with management to review shop rules, cleaning and closing procedures. Monthly Members (You) will operate in the school autonomously without supervision. You are expected to know how to run machines safely. If not, do not use that tool.

Do’s

Check the school calendar before coming to the shop - austinschooloffurniture.com/calendar/
Feel free to use the refrigerator
Feel free to use a bench to work on your projects
Stack projects in back storage room when not in use
You may keep lumber in lumber storage but each board must be clearly marked
You may use any of the schools scrap wood located in scrap bin
If something breaks or is not working, let management know immediately

Dont's

Do not do anything unsafe, you have not done before, risky or potentially harmful to our machines.
Always lock up and turn the alarm when exiting the building. Check all doors, even the ones you did not use.
Clean up fully each and every time you leave the shop
Nothing should be left out when you leave unless agreed upon with management - ie: Glue-ups
Do not move or use any machines that have been labeled, “Do Not Move”
Please do not use the schools handtools

LIABILITY WAIVER

I understand that my taking classes from Austin School of Furniture and Design LLC (the “School”) shall involve using power tools and other dangerous equipment. I also recognize that there is an inherent risk of injury or death when building furniture due to materials, equipment and working with other students and teachers. I also recognize that taking classes may involve risk of physical injury to others, or damage to my property, or other consequences, which might result from my own actions, and/or the actions, inactions or negligence of others, the rules of the School, condition of the premises, weather conditions, or condition of any of the equipment used in the School. There may also be other risks not known or not reasonably foreseeable.

On behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, and anyone else who might sue on my behalf, I HEREBY WAIVE, RELEASE, and FOREVER DISCHARGE Austin School of Furniture and Design LLC, and its agents, officials, officers, teachers, contractors, managers, owners, and employees and all other persons or entities involved with the School, and the officers, directors, employees, agents, insurers, other participants and representatives of all of the above (collectively, the "Released Parties"), from any and all claims, causes of action, damages, losses (economic and noneconomic), and liabilities of every kind (collectively "Claims"), for death, personal injury, or property damage, which may arise out of, result from, or relate to my assistance/participation in, or my traveling to or from, classes and any other school related activities, including but not limited to any Claims for theft, damage to any equipment, negligence, partial or permanent disability, Claims relating to the provision of first aid, medical care, medical treatment, or medical decisions (at the School site or elsewhere), and any Claims for medical or hospital expenses.

I assume any and all risks for injury to person or property, or any other consequence arising out of my assisting in, participating in, or attending classes and other activities, including travel en route to and from the School and activities. I HEREBY WAIVE AND RELEASE MY LEGAL RIGHTS TO SUE FOR ANY INJURY OR OTHER DAMAGE ARISING OUT OF OR RESULTING FROM MY PARTICIPATING AT THE SCHOOL.

I FURTHER COVENANT and AGREE NOT TO SUE any of the Released Parties for any of the Claims that I have waived, released, or discharged herein. I AGREE TO INDEMNIFY and HOLD HARMLESS the Released Parties from any and all expenses incurred, Claims made, or liabilities assessed against them, including but not limited to attorneys’ fees and litigation expenses, arising out of or resulting from, directly or indirectly, in whole or in part, my breach or failure to abide by any part of this Waiver Agreement, and my actions or inactions which cause injury or damage to any other person.

This agreement may not be modified orally. A written waiver of any provision of this agreement shall not be construed as a modification of any other provision, or as a consent to any other provision, or as a consent to any subsequent waiver of modification.

If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Waiver Agreement and shall not affect the validity and enforceability of any remaining provisions.

I understand and agree that this Agreement will be governed under the laws of the State of Texas and venue for any dispute related to this Waiver shall be in Austin, Travis County, Texas.

This Waiver of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I acknowledge that I have read and understand this entire document, and I agree to be legally bound by it.
